RE: The tariff classification of Category 5 and Category 6 telecommunication cable from China

Dear Mr. Bloch:

In your letter dated November 26, 2007, on behalf of Jo-Dan International, you requested a tariff classification ruling. The samples which you submitted are being retained by this office.

The items concerned are Category 5 and Category 6 telecommunication cables. Both types of cable consist of eight individually insulated copper wires, in a twisted-pair configuration, encased within an insulating jacket. These cables will be imported both in bulk form without connectors, and in various lengths with RJ45 plastic clip connectors attached. These cables are to be used with computers and computer equipment to allow for the transfer/communication of information/data. For example, this type of cable may be used to connect an individual computer to a modem, or to connect a network of computers and equipment to one another, such as in a LAN system.

The applicable subheading for the Category 5 and Category 6 telecommunication cables when imported in bulk without connectors will be 8544.49.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Insulated wire, cable and other insulated electric conductors, whether or not fitted with connectors…: Other electric conductors, for a voltage not exceeding 1,000 V: Other: For a voltage not exceeding 80 V: Of a kind used for telecommunications”. The rate of duty will be free.

The applicable subheading for the Category 5 and Category 6 telecommunication cables when imported cut to length with attached RJ45 connectors will be 8544.42.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Insulated wire, cable and other insulated electric conductors, whether or not fitted with connectors…: Other electric conductors, for a voltage not exceeding 1,000 V: Fitted with connectors: Other: Of a kind used for telecommunications”. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
